Acceptance of Terms
Welcome to Aetherrax! By accessing or using the ThunDroid mobile application (the “App”), provided by Aetherrax (“we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). These Terms govern your use of the App and any related services. If you do not agree with any part of these Terms, you may not access or use the App.
Intellectual Property
All intellectual property, including the application, its icon, designs, logo, and all associated content, are exclusively owned by Aetherrax Technologies and protected under applicable intellectual property laws. Unauthorized use of any such materials without express written consent from Aetherrax Technologies is strictly prohibited and may result in legal action. Your use of the App does not grant you ownership of any content, including AI-generated responses. Conversation data stored locally remains your property but may be subject to third-party AI service terms. Your use of third-party AI services through the App is governed by their respective terms and privacy policies.
App Functionality
ThunDroid is an AI-powered conversational interface designed as a mental health companion. It utilizes third-party AI models to generate responses and primarily stores conversation history and related data locally on your device. All advanced features and full functionality require an in-app subscription purchase, as detailed below.
Medical Disclaimer
ThunDroid is not a substitute for professional medical advice, diagnosis, or treatment. It is intended solely for informational and emotional support purposes. You should always consult a qualified healthcare provider for any medical or mental health concerns. Do not rely on ThunDroid to make medical decisions, and never disregard or delay seeking professional medical advice due to information or responses provided by the App. In case of a medical emergency, contact your doctor or emergency services immediately.
User Responsibilities
- You are solely responsible for your use of the App and any decisions made based on AI-generated responses.
- You must secure your device (e.g., using passcodes or biometric authentication) to protect data stored locally by the App.
- You agree not to use the App for any illegal, unauthorized, or harmful purpose, including but not limited to violating intellectual property rights or engaging in fraudulent activities.
Subscriptions and In-App Purchases
- Subscription Model: Access to premium features (e.g., advanced therapeutic conversations, enhanced crisis support, and additional credits) requires a subscription per month, including a 3-day free trial with 1,000 ThunDroid credits. Upon renewal, you receive 3,200 credits per cycle.
- Auto-Renewal and Cancellation: Subscriptions are managed through your App Store account and will auto-renew unless canceled at least 24 hours before the current period ends. You can cancel via your App Store settings. No refunds are provided for unused portions of a trial or subscription period.
- Payment and Refunds: All payments are processed via the App Store. Refund requests should be directed to Apple Support, subject to their policies.
- Changes to Pricing: We reserve the right to modify subscription prices with prior notice via the App or email.
Limitation of Liability
To the fullest extent permitted by applicable law, Aetherrax Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses, arising from: (a) your access to or use of the App; (b) any third-party content or AI-generated responses; or (c) unauthorized access to or alteration of your locally stored data. Our total liability shall not exceed the amount you paid for the App, if any.
Disclaimer of Warranties
The application is provided by Aetherrax Technologies on an “AS IS” and “AS AVAILABLE” basis, without any warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. While Aetherrax Technologies implements industry-standard encryption and local data storage practices to safeguard user data, we do not guarantee that the application will be uninterrupted, error-free, or immune to all security risks.
Termination
We may terminate or suspend your access to the App immediately, without prior notice, if you breach these Terms. Upon termination, your right to use the App ceases, and any locally stored data will remain on your device unless you delete it.
Changes to Terms
We may update these Terms at any time. Significant changes will be notified via an update to the “Last Updated” date and a notice within the App. Your continued use of the App after such changes constitutes acceptance of the new Terms.
Governing Law and Dispute Resolution
These Terms are governed by the laws of India. Any disputes shall be resolved through arbitration, unless otherwise required by law.
